The following terms and conditions apply to all quotations and agreements issued by the Illustrator Danraz0r.1. TERMS AND CONDITIONS, QUOTATION AND CONFIRMATION.1.1 These terms and conditions for freelance Art commission work are valid for all quotations and all other concluded agreements. Any deviations on these terms and conditions can only be concluded in writing between client and illustrator.1.2 The indicated prices can be subject to change as a consequence of unforeseen alterations of the commission or commissions for commercial purposes1.3 Commission details will be confirmed in writing by the client via discord DMs or E-mail. The terms of the quotation shall be deemed agreed and these terms and conditions apply.2. WORK AND PAYMENT.2.1 Project. The Client is hiring for the Illustrator to do the following:
The development of the Art mentioned and discussed, in the function of illustration.
Updates for the artwork and information will be sent via Discord DMs or Email.
The emphasis is on providing commission work complete with package sent via E-mail.
Finished digital product package will be sent upon completion i.e: raw files(PSD files, CLIP files), sketches.via E-mail.2.2 Schedule. The Illustrator will begin work once the agreed upon payment has been administered and will continue until the work is completed. Artworks such as illustrations can take up to approximately 1-2 weeks for completion (certain exemptions are allowed depending on the complexity and workload). This Contract can be ended by either Client or Illustrator at any time, pursuant to the terms of Section 4, (Term and Termination).2.3 Payment. Two part invoice will be sent. Initial Payment must be paid upfront to start. (50% of the total commission) after the commission is finalized completion of the remaining 50% payment should be paid. (Can be fully paid if requested by the client.)2.4 Mode of payment. The illustrator will invoice the Client via Paypal. The Client agrees to pay the amount owed within 15 days of receiving the invoice. Failing to pay within the time period will result in cancellation and a loss of the right for the slot.2.5 Refund policy I don't allow refunds after the work has been started, Only the Illustrator has the ability to refund the amount if the Illustrator wishes to stop the operating commission at any time.3. LIABILITY
3.2 The Illustrator is not liable for any viruses, malware, or other harmful programs that he may unintentionally transmit, or the damages they may cause.3.3 The Illustrator is not liable for any copyright infringements that may occur if he uses imagery that the client specifically requests.3.4 If the Illustrator is unable to continue or finish his work due to serious illness, injury, technical problems, or other major obstacles, the agreement will be deemed completed as if under normal circumstances. The Illustrator will then be released from his obligations and will deliver the work done so far if possible. The client will only pay a portion of the fee proportional to the working days that the Illustrator worked so far.3. OWNERSHIP AND LICENSES FOR COMMERCIAL PURPOSES
(The illustrator may grant all rights or limited rights of the project illustrations to the client, depending on the fee and the scope of the project)3.1 Client Owns All Work Product. As part of this job, the illustrator is creating a “work product” for the Client. To avoid
confusion, work product is the finished product, as well as drafts, notes, mockups, designs, and anything else that the Illustrator works on within the commission work—that is, conceives, creates, designs, develops.
invents, works on, or reduces to practice—as part of this project, whether before the date of this Contract or after. The
Illustrator hereby gives the Client this work product once the Client pays for it in FULL. This means the Illustrator is giving
the Client all of its rights, titles, and interests in and to the work product (including intellectual property rights). and the
Client will be the sole owner of it. The Client can use the work product however it wants or it can decide not to use the
work product at all. The Client, for example, can modify, destroy. or sell it, as it sees fit.3.2 Illustrator’s Use Of Work Product. Once the Illustrator gives the work product to the Client, the Illustrator does not
have any rights to it, except those that the Client explicitly gives the Illustrator here. The Client gives permission to use
the work product as part of portfolios and websites, in galleries, and in other media, so long as it is to showcase the work and not for any other purpose.4.TERM AND TERMINATION. This Contract is ongoing until the work is completed. Either party may end this Contract
for any reason by sending an email or DMs to the other party, informing the recipient that the sender is ending the Contract
and that the Contract will end in 7 days. The Contract officially ends once that time has passed. The party that is ending the
Contract must provide notice.
The Illustrator must immediately stop working
as soon as it receives this notice, unless the notice says otherwise. The Client will pay the Illustrator for the work done up
until when the Contract ends and will reimburse the Illustrator for any agreed-upon, non-cancellable expenses. The
the following sections don't end even after the Contract ends: (Ownership and Licenses)(Confidential Information) (Limitation of Liability)(Indemnity).5. GOVERNING LAW, The laws of Philippines govern the rights and obligations of the Client and the Illustrator under
this Contract, without regard to conflict of law principles of that country.
